However, in court, we successfully proved that the entry and residence ban was\nunfounded and disproportionate.<\/p><p data-start=\"174\" data-end=\"264\">\u00a0<\/p><p data-start=\"174\" data-end=\"264\">On May 14, 2025, the Supreme Administrative Court of Lithuania annulled the five-year ban\nimposed by the Migration Department on our client\u2019s entry and residence in the Schengen\nArea, accepting the arguments presented in our appeal. The court clarified that a decision to\nprohibit a third-country national from entering the Republic of Lithuania for a certain period\nshould not automatically lead to the issuance of a warning in the second-generation\nSchengen Information System (SIS II). Before entering such a warning, competent\nauthorities are obliged to assess whether the case is adequate, relevant, and sufficiently\nserious to justify the alert, taking into account its impact on the individual\u2019s rights and\nproviding substantiated reasoning.<\/p><p data-start=\"174\" data-end=\"264\">\u00a0<\/p><p data-start=\"174\" data-end=\"264\">The court agreed with our argument that the Migration Department\u2019s decision lacked\njustification regarding the proportionality of the SIS II alert. It did not include an individualized\nassessment of the applicant, taking into account personal circumstances\u2014such as family or\neconomic ties\u2014and the consequences of the entry and residence ban.
